Contract – Incapacity – Mental impairment – Settlement

Where a plaintiff’s request for an order enforcing a settlement agreement was denied based on a Superior Court judge’s conclusion that, due to mental impairment, one of the defendants lacked the capacity to contract at the time of agreement, the judge’s decision must be reversed because the evidence was insufficient to support a determination of incapacity.
